Special Council Jack Smith has filed a motion to drop all 4 felony charges against Donald Trump in connection with the 2020 election and January 6th. He cites a "a long-standing Justice Department policy that bars the prosecution of a sitting president." The Grand Jury first indicted Trump 16 months ago, as he geared up for his third Presidential campaign.
"As a result of the election held on November 5, 2024, the defendant, Donald J. Trump, will be inaugurated as President on January 20, 2025," Smith's motion said. "It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President. But the Department and the country have never faced the circumstance here, where a federal indictment against a private citizen has been returned by a grand jury and a criminal prosecution is already underway when the defendant is elected President."
interestingly, it seems that if not prosecuting a sitting President were the issue - that Smith would simply pause the charges wait 4 years rather than dismissing them. Trump is ineligible for another term, and only has 4 years left as President.
There is no evidence that Donald Trump unlawfully attempted to overturn the 2020 election, there is no evidence that he asked, ordered or coerced individuals to forge slates of electors and there is no evidence that he coordinated violence on January 6th.
They told you for months that this wasn’t political, that it wasn’t to prevent him from holding office, and as soon as Donald Trump is elected, the legal cases against him begin dropping like flies.
Even the sentencing in Donald Trump’s New York “hush money” trial has been paused indefinitely. It’s worth noting that the formal designation required to make someone a felon does not happen until sentencing.
A month ago, memos and investigations from Jack Smith were the new silver bullet that the left tried to use against Donald Trump, and now even he is giving up.
Smith says that his position has not changed but “the circumstances have” which seems to be quite an odd reason to drop legal recourse. Perhaps, because the case was always political, from the very start.
